If you are interested in using CBD oil in Arizona, read on for everything you need to know about CBD in the Grand Canyon State.

Overview of CBD Laws in Arizona

Here is a look at how laws and regulations surrounding hemp and CBD have progressed over the past few years on the state and federal level:

2010: Proposition 203 was passed in Arizona, legalizing medical marijuana in the state. The Arizona Department of Health Services was given the responsibility to regulate the Arizona Medical Marijuana Act.

2014: President Obama signed the 2014 Farm Bill which, among other things, allowed for the research of industrial hemp (under certain restrictions). In Arizona, a Maricopa County Superior Court judge ruled that extracts from cannabis plants, including CBD oil, were protected under Proposition 203, and could be used by patients with a medical card.

2018: In the middle of the year, Governor Doug Ducey signed Senate Bill 1098. This bill provided funding for the Arizona Department of Agriculture to start an industrial hemp pilot program. Through this program, universities and those with a license could cultivate industrial hemp with less than 0.3% THC. Later this year, the 2018 Farm Bill was signed by President Trump. This bill broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: The Arizona Peace Officer Standards Training Board made a statement clarifying that it did not consider the use or possession of hemp-derived CBD products with less than 0.3% THC to be illegal.

CBD Laws in Arizona: What They Mean

What this tells us is that industrial hemp-derived CBD products are legal in Arizona, so long as they contain less than 0.3%. CBD can be extracted from stalk fiber, hemp mature stalks, and sterilized seeds. However, the regulations around these hemp-derived products are still underdeveloped.

The Arizona Department of Agriculture issues licenses to qualified groups that wish to grow, transport, harvest, or process hemp. Researchers are also required to obtain their own licenses. However, the oversight stops there. The AZDA does not have any hemp-specific regulations or licenses for retailers. The department states that manufacturing of industrial hemp-derived CBD products is legal in the state, but that they do not provide any regulations to retailers.

As of now, it is unclear whether the AZDA will create their own regulations surrounding the sale of hemp-derived products. They may wait for guidance of the FDA, which does not currently regulate the sale or production of CBD, or other regulatory agencies to establish their own regulations.

Is CBD Oil in Arizona Legal?

Yes, CBD oil laws in Arizona allow for residents to use and possess hemp-derived CBD products containing less than 0.3% THC. Medical marijuana is legal in the state, so those with a medical marijuana card may have access to cannabis oil (oil derived from marijuana that has a higher concentration of THC), as well as other marijuana-derived products. Residents without a medical marijuana card can still enjoy hemp-derived CBD oil in Arizona.

Things to Know

Since the AZDA does not regulate the sale of CBD products in the state, Arizona residents should practice caution when purchasing CBD. While they do regulate the cultivation of hemp in the state, the actual hemp-derived products made in the state could be mislabelled or contain harmful elements. If you are thinking of purchasing CBD in Arizona, you should keep these factors in mind.

  • Third-Party Testing: Residents in Arizona and beyond should only purchase CBD from a company that puts their products through third-party testing. That way, they can ensure the correct amount of CBD is in the product, and that no harmful elements are in the formula.
  • Hemp Source: The quality of hemp plays a big part in the quality of a CBD product. It is vital that a company knows exactly where their hemp is coming from. That way they know the regulations and agricultural practices that go into growing the hemp they use for their products – and can be confident that they are using the highest-quality plants.
  • Extraction Process: The extraction process plays a big part in the quality of the CBD. One method is ethanol extraction. Through this method, the plant is mixed with alcohol, and then the alcohol is evaporated. Typically, this process is less expensive for companies, but can result in less potent CBD. Plus, there can be traces of solvent in the final product. A higher-caliber method is CO2 extraction. With CO2 extraction, a machine uses pressurized carbon dioxide to extract oil from the plant. It leads to a more potent CBD that isn’t at risk of containing traces of solvent.
