2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: The Iowa Hemp Act was signed into law. It required the Iowa Department of Agriculture and Land Stewardship to create and submit a hemp cultivation plan to the USDA. It also gave DALS the authority over the production of hemp once the plan was approved by the USDA. DALS submitted the plan to the USDA at the end of 2019, and is awaiting approval. 

CBD Laws in Iowa: What They Mean

The CBD laws in Iowa are somewhat misleading, and have caused a lot of confusion for residents. At the time of this article being written, the USDA has not yet approved the submitted hemp plan. This means, per DALS’s website, it is not yet legal to grow, possess, buy, or sell hemp in Iowa – but it is expected to be accepted and then legalized in 2020. Many residents have been under the impression that, with the Iowa Hemp Act, hemp-derived CBD is legal in Iowa, or at least it would be with the approval of the plan.

In 2019, Governor Kim Reynolds said that, although hemp production is on its way to being legal, the production and sale of hemp-derived CBD products still remains illegal. The Attorney General also stated that no one could grow, manufacture, or process hemp besides the two licensed medical CBD manufacturers in the state. 

It is possible that the state could legalize hemp-derived CBD once the plan is approved by the USDA. Alternatively, the state may be waiting for approval of the FDA. Either way, as it stands now, hemp-derived CBD is not legal for residents in Iowa. Medical CBD is available for patients registered with the Department of Public Health. These residents can access medical CBD from one of the five state dispensaries.
