The laws around CBD in Nebraska are murky. In 2018, the Nebraska Attorney General made a statement that CBD remains illegal under state law, despite the fact that it is legal federally under the 2018 Farm Bill. LB 657 does open the door for the possibility of legalizing hemp-derived CBD products, as it states that it is legal to possess, transport, sell, and buy hemp products, so long as they are lawfully made.

The missing piece, however, is that the law does not specifically define “hemp products,” making it unclear whether hemp-derived CBD products fall under that category. So, at the time of writing this article, it appears that the state is still in-line with the Attorney General’s statement. Since the Nebraska Department of Agriculture is awaiting approval of the hemp plan from the USDA, it is possible that clearer laws and regulations around CBD will be established in the near future.
