Cannabidiol Laws in Georgia

Here is a quick look at how the laws surrounding CBD and hemp have evolved in Georgia and on the federal level over recent years:

2014: President Obama signed the 2014 Farm Bill. This bill allowed for the research of industrial hemp, under certain restrictions.

2015: House Bill 1 (also known as Haleigh’s Hope Act) was passed in the state. It allowed registered patients with severe or chronic health issues to possess up to 20 ounces of low-THC cannabis oil. It also enabled universities to research CBD to see how it could help children with seizure disorders.

2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. This bill removed hemp from the definition of marijuana. This meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: Georgia passed House Bill 213. This bill legalized the commercial production of hemp and hemp-derived products, and removed hemp from the list of controlled substances in the state. It requires growers and processors to get proper licensing through the Georgia Department of Agriculture.

2020: The GDA submitted the Georgia Hemp Plan to the US Department of Agriculture for approval. Once it is approved by the USDA, the GDA will begin giving out licenses to growers and processors.

CBD Laws in Georgia: What They Mean

What does this all mean for CBD in Georgia? Under House Bill 213, hemp-derived CBD products are legal to produce, sell, and use in the state.

Hopefully, the hemp agriculture will boom in the state once the GDA is able to give out licenses to growers and processors. Residents in Georgia, however, do have to keep a few things in mind when purchasing CBD products in the state.

One thing to note is the legality of CBD in food. House Bill 213 defines “hemp products” as those meeting the federally defined THC level, and derived from legal hemp plants.

The agriculture commissioner, however, noted that food products (including pet food) cannot be infused with CBD oil.

Also, while there are regulations and laws being put in place around the cultivation of hemp, there currently are not regulations around the sale and marketing of hemp-derived CBD products.

While these regulations may be established in the near future, residents need to keep a few important factors in mind to make sure they are getting the best quality CBD products – we’ll cover some tips below.

Is CBD Oil Legal in Georgia?

Residents looking to buy CBD oil in Georgia are in luck. Hemp-derived CBD oil that contains less than 0.3% THC is legal to sell, possess, and use in the state.

Georgia residents do need to keep in mind that CBD oil currently isn’t regulated, so there is a risk of products being mislabelled.

Under House Bill 1, certified residents with a medical card are able to access low THC oil, which is derived from the marijuana plant. This oil can contain up to 5% THC. Non-qualified residents can still enjoy legal hemp-derived CBD oil in the state.

Things to Know When Purchasing CBD in Georgia

CBD is unregulated in Georgia, which means residents need to pay close attention to the products they are purchasing. Reputable brands will meet high standards regarding third-party testing, the quality of hemp used, and the extraction process.

When you purchase from brands that meet these standards, you’ll be more confident in knowing you are using high-quality hemp-derived CBD products.

As far as hemp sourcing goes, a top brand will know exactly where their hemp is coming from. They will be sure that the hemp comes from a farm that has strict regulations and agricultural practices in place.

That way, they can be confident in knowing they are using the highest quality plants. Third-party testing is also an essential process for any CBD company that wants to sell top of the line products. This process helps companies confirm their products contain the right amount of CBD, and that there aren’t any additional harmful elements in the products.

Finally, there is the extraction process used to source CBD. The top companies will use CO2 extraction, a process where a machine extracts oil from the hemp plant.

Companies that are trying to cut corners will use a cheaper method called ethanol extraction.

Through this method, alcohol is mixed with the plant and then evaporated. There is a risk of solvent being left behind in the CBD.

Plus, this method leads to less potent CBD. Of course, neither of these risks are ideal for the consumer.
