Are you an Alaska resident curious about the laws and regulations surrounding hemp-derived CBD in your state? Here is everything you need to know about CBD oil laws in the Last Frontier.

Overview of CBD Laws in Alaska

This is a short overview of how laws surrounding hemp and CBD have progressed in Alaska over recent years:

2014: President Obama signed the 2014 Farm Bill which, among other things, allowed for the research of industrial hemp (under certain restrictions).

2015: In Alaska, Senate Bill 8 was signed. This bill legalized the production of industrial hemp, and created a foundation for the regulation and production of the plant. It defined industrial hemp as not having more than 0.3% THC.

2017: House Bill 172 was passed in the state. It stated that higher education institutions could create and oversee agricultural pilot programs to study the growth, cultivation, or marketing of industrial hemp. This bill clarified the definition of industrial hemp, saying that it is not included in the definition of marijuana. It also clarified that adding industrial hemp to food didn’t create an adulterated food product.

2018: Senate Bill 6 was passed in the state, which authorized the state to continue moving forward with developing a pilot program for industrial hemp growers. It was in compliance with the 2014 Farm Bill. It stated that cannabidiol oil was excluded from the definition of hashish oil. Later this year, the 2018 Farm Bill was signed by President Trump. This bill broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

Laws in Alaska: What They Mean

What exactly does all of this mean in regards to hemp-derived CBD products in Alaska? At the time of this article being written, hemp-derived products are available for purchase in Alaska. However, while industrial hemp itself is regulated, Senate Bill 6 did not address regulations surrounding the processing of hemp-derived products.

That all being said, it seems that Alaska is on the brink of establishing regulations. In May of 2019, the Alaska Department of Natural Resources released proposed industrial hemp rules. These proposed rules allow the DNR to issue industrial hemp registration for growers, processors, and retailers. Registered processors would be able to process industrial hemp into other forms or products. For hemp products intended for human or animal consumption, the processors must put the products through testing (performed by the DNR or at an authorized testing facility) for cannabinoid concentration and residual elements. Registered retailers would be able to sell processed industrial hemp and related products. The retailers would have to ensure that all products are labeled properly.

These regulations are promising, and establish more concrete guidelines that allow Alaska residents to access higher quality hemp-derived CBD products. However, the DNR has yet to actually enforce these regulations.

Overall, Alaska has a friendly view towards industrial hemp and hemp-derived products. While hemp-derived products are not currently regulated, Alaska is seemingly on the way towards doing so.

Is CBD Oil in Alaska Legal?

This all begs the question: what are the CBD oil laws in Alaska? CBD oil is currently easily accessible in the state. However, since it is still unregulated, consumers have to practice caution when buying hemp-derived CBD oil in Alaska (as well as other hemp-derived CBD products).

Buying CBD in Alaska

Since CBD is currently unregulated, consumers in Alaska need to be particularly cautious when purchasing CBD products in the state. That being said, even when regulations are set in place, consumers should still do their due diligence to make sure they are purchasing from a brand that produces high-quality CBD products. These are some of the factors Alaska residents should keep in mind when purchasing CBD products:

  • Third-Party Testing: Residents in Alaska should only purchase CBD from a company that puts their products through third-party testing. That way, they can ensure the correct amount of CBD is in the product, and that no harmful elements are in the formula.
  • Hemp Source: The quality of hemp plays a big part in the quality of a CBD product. It is vital that a company knows exactly where their hemp is coming from. That way they know the regulations and agricultural practices that go into growing the hemp they use for their products – and can be confident that they are using the highest-quality plants.
  • Extraction Process: The extraction process plays a big part in the quality of the CBD. One method is ethanol extraction. Through this method, the plant is mixed with alcohol, and then the alcohol is evaporated. Typically, this process is less expensive for companies, but can result in less potent CBD. Plus, there can be traces of solvent in the final product. A higher-caliber method is CO2 extraction. With CO2 extraction, a machine uses pressurized carbon dioxide to extract oil from the plant. It leads to a more potent CBD that isn’t at risk of containing traces of solvent.
