Overview of CBD Laws in Iowa

Let’s take a look at the laws surrounding CBD and hemp in Iowa and on the federal level.

2014: On the federal level, President Obama signed the 2014 Farm Bill, which allowed for the research of industrial hemp (under certain restrictions).

2015: In Iowa, Senate Bill 2360 (the Medical Cannabidiol Act) was passed, and it went into effect in 2015. It allows residents with epilepsy to use hemp-derived CBD products with no more than 3% THC, with written recommendation from a neurologist.

2017: An expanded Medical Cannabidiol Act was signed into law. It allows patients with other diseases to use CBD products. These diseases include cancer, chronic pain, multiple sclerosis, Chron’s disease, Parkinson’s disease, HIV/AIDS, and more.

2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: The Iowa Hemp Act was signed into law. It required the Iowa Department of Agriculture and Land Stewardship to create and submit a hemp cultivation plan to the USDA. It also gave DALS the authority over the production of hemp once the plan was approved by the USDA. DALS submitted the plan to the USDA at the end of 2019, and is awaiting approval.

CBD Laws in Iowa: What They Mean

The CBD laws in Iowa are somewhat misleading, and have caused a lot of confusion for residents. At the time of this article being written, the USDA has not yet approved the submitted hemp plan. This means, per DALS’s website, it is not yet legal to grow, possess, buy, or sell hemp in Iowa – but it is expected to be accepted and then legalized in 2020. Many residents have been under the impression that, with the Iowa Hemp Act, hemp-derived CBD is legal in the state, or at least it would be with the approval of the plan.

In 2019, Governor Kim Reynolds said that, although hemp production is on its way to being legal, the production and sale of hemp-derived CBD products still remains illegal. The Attorney General also stated that no one could grow, manufacture, or process hemp besides the two licensed medical CBD manufacturers in the state.

It is possible that the state could legalize hemp-derived CBD once the plan is approved by the USDA. Alternatively, the state may be waiting for approval of the FDA. Either way, as it stands now, hemp-derived CBD is not legal for residents in Iowa. Medical CBD is available for patients registered with the Department of Public Health. These residents can access medical CBD from one of the five state dispensaries.

What Does This Mean for Iowa Residents?

Here is one thing to keep in mind: hemp-derived CBD products containing under 0.3% THC are legal in all 50 states under the 2018 Farm Bill. This means that many CBD online retailers are able to legally ship their hemp-derived CBD products around the country, including to residents in Iowa. Residents who want to use federally legal CBD products need to stay on top of state regulations and make a decision that is best for them. Most importantly, they need to look for high-quality products coming from a reputable company.

What Iowa Residents Should Know When Purchasing CBD Online

If you are an Iowa resident looking to order CBD online, you need to keep a few things in mind. There are a lot of options available from online retailers, but it is important to know what to look for – and how to separate the reputable companies from the untrustworthy ones.

First, you need to see where the company sources its hemp. Companies that source their hemp from overseas or farms where few to no regulations are in place are going to produce substandard hemp. Hemp that isn’t high-quality leads to low-quality CBD products.

You also should look into the extraction method the company uses to extract CBD. Companies that produce high-quality CBD products will use CO2 extraction, a method where a machine uses pressurized carbon dioxide to extract the hemp. A lower-quality method is ethanol extraction, which uses an alcohol solvent to extract the hemp. This method leads to less potent CBD, and there is also a risk of solvent being left behind in the CBD.

Perhaps most importantly, you need to make sure the company puts their products through third-party testing. If a company doesn’t put their products through testing, they have no way of knowing if the CBD dosage is accurate, and can’t ensure that the product doesn’t contain any unintentional harmful elements.
