House Bill 491 was also passed. It established the details for Louisiana’s hemp cultivation plan, which is overseen by the Louisiana Department of Agriculture and Forestry (LDAF).

It also allowed for the sale of hemp-derived CBD products, and established regulations around them. At the end of the year, the USDA approved Louisiana’s state industrial hemp plan. The LDAF then began to accept license to produce, transport, and process hemp in the state. 

CBD Laws in Louisiana: What They Mean

Luckily for Louisiana residents, these laws allow for the use of hemp-derived CBD products that contain less than 0.3% THC. Hemp and hemp-derived products are well-regulated in the state, but there are a few limitations to what can be sold. 

In Louisiana, the processing or sale of the following CBD items is prohibited: anything meant for inhalation, an alcoholic beverage infused with CBD, and any food or beverage product containing CBD (unless the FDA approves CBD as a food additive). 

As far as regulation goes, all CBD products sold in the state must be registered through the Louisiana Department of Health. CBD products that are manufactured, distributed, imported, or sold in the state must be produced from legal hemp that was grown in accordance with a state plan that was approved by the USDA. Here are a few other regulations to be aware of:

  • The label needs to contain a statement that the product wasn’t evaluated by the FDA. It also can’t have a medical claim, and must have a scannable barcode, QR code, or a web address that links to the certificate of analysis. 
  • The certificate of analysis needs to include the batch ID number, date received, date of completion, and the method of analysis. It also must show test results. 
  • Retailers need to obtain a permit from the Louisiana Office of Alcohol and Tobacco Control. 
  • Facilities manufacturing or distributing products in Louisiana meant for human consumption must be permitted by the Food and Drug Unit of the Office of Public Health.
