While CBD in food was initially banned in the state, under LD 630, CBD-infused food products became unadulterated, meaning they are legal to sell and use.

Packaged food labels must indicate that they contain CBD, describe the CBD content, include the name and address of where the hemp was sourced, and include a statement saying that the product hasn’t been tested for safety. Tinctures and extracts must also indicate the batch number. 

There are requirements for unpackaged CBD foods as well, such as in the case of a coffee shop that adds CBD to coffee drinks.

The menu or visible signage must clearly note the inclusion of CBD in the products. The establishment must also display a directory that has information on any products that include CBD.

Consumable hemp-derived CBD products (regardless of whether they are packaged or unpackaged) can’t be marketed with a claim that they can cure or prevent any disease, condition, or injury (without the approval of the FDA). 

Maine residents should also note that recreational marijuana is also legal in the state, so it is possible to find cannabis oils and other marijuana-derived products with a higher concentration of THC.
