2014: On the federal level, President Obama signed the 2014 Farm Bill, which allowed for the research of industrial hemp (under certain restrictions). 

2016: Question 4 was approved in Massachusetts. It legalized recreational marijuana for those over the age of 21. 

2017: The Industrial Hemp Pilot Program was launched in Massachusetts, establishing regulations for the commercial production of hemp. The Massachusetts Department of Agricultural Resources (MDAR) has oversight of the program, and gives out licenses for hemp cultivators and processors.  

2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

CBD Laws in Massachusetts: What They Mean

Unfortunately, Massachusetts is not currently a CBD-friendly state, despite the fact that it does have a hemp program. There are many hemp-derived products that have been deemed legal to produce and sell in the state, including hemp seeds, hemp seed oil (which is different than CBD oil), hemp protein, clothing, and building material. However, the state is not as open to hemp-derived CBD products. 

Massachusetts officials are following the lead of the FDA, which has not approved hemp-derived CBD products (besides one prescription-based drug that contains CBD).

The MDAR has stated that the following products are illegal: any product containing hemp-derived CBD that makes medicinal or therapeutic claims, any product that contains hemp as a dietary supplement, any food containing CBD, and animal feed that contains hemp products. 

As noted in the overview of laws above, recreational marijuana is legal in Massachusetts. This means that it is possible for residents to possess a small amount of marijuana-derived products, such as cannabis oil (which has a higher concentration of THC). 

It should be noted that a house bill was introduced in Massachusetts in July of 2019. It proposes that hemp-derived CBD products become unadulterated, and would open up the possibilities for the legal sale of CBD in the state. However, at the time of writing this article, it has not yet passed.

The MDAR has stated that it is waiting for additional guidance from the USDA before creating a hemp plan to submit for approval.

Once this plan is submitted, it is possible that the state may open up the possibilities for the sale of hemp-derived CBD, and create regulations to ensure consumer safety. Alternatively, it may wait for FDA guidance on CBD products. As of now, the future of hemp-derived CBD in Massachusetts is a bit murky.
