2017: In New Mexico, Senate Bill 6 was passed. It created an industrial hemp program in the state, allowing for the cultivation of industrial hemp for research purposes. This program was overseen by the New Mexico Department of Agriculture (NMDA). 

2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. This bill removed hemp from the definition of marijuana. This meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: In New Mexico, House Bill 581 was passed. It created regulations for “hemp finished products,” which includes products intended for retail sale that contain hemp or hemp extract, and that have no more than 0.3% THC. These products can be food, food additives, and herbs meant for human use. These products are regulated by the New Mexico Environment Department (NMED). 

CBD Laws in New Mexico: What They Mean

CBD laws in New Mexico have very recently gone through a big shift, but in short, it is a CBD-friendly state. 

After HB 581 was passed, the NMED issued a set of rules which were in effect from August 1, 2019 to January 28, 2020. These interim rules were put in place to create standards around the transportation, extraction, processing, and testing of hemp products, and to give the department time to establish more concrete rules. The NMED established the final rules, and they went into effect on January 28, 2020. 

Under the final rules, hemp products (including  CBD oil New Mexico and CBD products meant for human use and consumption) are well-regulated. The rules established an application and permitting process for those involved in the transportation, extraction, storage, or processing of hemp products in the state. They also established testing requirements for usable dried hemp, testing requirements for hemp products, labelling requirements, and much more. The label on a hemp product must list the CBD content in milligrams, the THC content in milligrams, a code signifying the date and place of manufacture, and a statement saying the FDA hasn’t evaluated the product. Hemp products also can’t say that they contain no THC, unless otherwise approved. Additionally, the label can’t contain any health or medical claims.
