2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. It also removed hemp from the definition of marijuana. This meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: Senate Bill 6184 was passed in New York. It established a state permit process for growers, processors, and sellers of hemp extract, as well as certain testing and labelling requirements for hemp products. 

CBD Laws in New York: What They Mean

So what does this all mean for residents of New York who want to use CBD products? Hemp-derived CBD is permitted for sale and use in the state, but there is an exception. In July of 2019, the New York Department of Agriculture and Markets issued a statement saying that the sale of food and beverages infused with CBD is not allowed in the state, following guidance of the FDA. Beyond that, hemp-derived CBD products containing no more than 0.3% THC are perfectly legal in the state. 

Under Senate Bill 6184, certain labelling and testing requirements were established for hemp products. These products must have a QR code that provides information on serving size, concentration, and the region where the product was grown. The labels also cannot contain any claims that they can treat, cure, or prevent diseases. 

There may be some shifts in laws and regulations around CBD in the near future. Currently, there is a new law being worked on in the state that requires licenses for processors and retailers. It also gives the state the ability to require retailers, distributors, and wholesalers of CBD to get permits.
