2019: In Texas, House Bill 1325 was signed into law. It authorized the production of hemp, and created regulations around the production, manufacture, and sale of hemp and CBD Texas. It also prohibited the processing or manufacturing of smokable hemp. This law gives the Texas Department of Agriculture (TDA) the oversight of the cultivation of hemp, and the Department of State Health Services (DSHS) the responsibility of regulating hemp products. 

2020: In January, the USDA approved the Texas state hemp production plan. The hemp rules under the TDA have been implemented, however, the final rules under the DSHS haven’t yet been released. 

CBD Laws in Texas: What They Mean

So what does this all mean for those who want to buy CBD in Texas? Hemp and CBD products are legal in the state, but there are still a few regulations that need to be established.

As mentioned, the TDA has started implementing rules regarding hemp cultivation, but the DSHS has yet to release its final rules. The DSHS will need to establish rules around the licensing, registration for retailers, and testing of hemp products. 

That said, it is important to note that retailers in the state are still allowed to transport, market, and sell hemp products under House Bill 1325. CBD in Texas must meet certain testing and labelling requirements. They must contain no more than 0.3% THC and be free of any harmful elements. In addition to buying from local retailers, consumers in the state are also able to legally purchase CBD products online

However, without rules by the DSHS in place, the manufacturing of consumable CBD in Texas (which includes cosmetics) within the state is not allowed. Once the rules are established by the DSHS, the products will be allowed to be manufactured in Texas. Retailers will also need to abide by any new rules that are created.
