2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. It removed hemp from the definition of marijuana. This meant that hemp-derived products lost their status as a Schedule 1 drug, so long as they have less than 0.3% THC. In Utah, House Bill 3001 was signed, allowing residents to legally possess CBD oil containing less than 0.3% THC. 

2019: In Utah, Senate Bill 105 was signed into law, requiring the UDAF to establish requirements for a license to cultivate, process, and market industrial hemp. 

CBD Laws in Utah: What They Mean

What does this all mean for Utah residents? In short, the state does allow for the sale of hemp-derived CBD products, and has strong regulations in place when it comes to all processes related to hemp and hemp products. 

Utah is currently operating under its industrial hemp program. Through this program, the UDAF has established robust regulations for growers, processors, transporters, and retailers of hemp and hemp products. 

Per the UDAF, hemp-derived products (such as CBD oil) are allowed to be sold and purchased in the state. These products must be registered with the UDAF, and meet specific labelling and testing requirements. Some of the most notable requirements include the following:

  • Products must contain no more than 0.3% THC
  • Products must have a QR code on the label that links to test results and batch information

A variety of hemp-derived CBD products (which are called “cannabinoid products”in the text of the law) are legal within the state, so long as they fit all requirements outlined within the UDAF’s requirements. UDAF does not license CBD in food and beverages (like candy and non-cubed gummies).
