Here is a quick look at the most recent federal and state laws regarding CBD in Virginia: 

2014: President Obama signed the 2014 Farm Bill, a bill that allowed for the research of industrial hemp, under certain restrictions. 

2015: In Virginia, House Bill 1445 was passed, allowing for the medical use of CBD oil for epilepsy, so long as it is prescribed by a medical professional.  

2018: House Bill 1251 was passed in Virginia, expanding the use of medical CBD oil for any condition that may benefit from it, as long as it is prescribed by a medical professional. On the federal level, the 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. It removed hemp from the definition of marijuana. This meant that hemp-derived products lost their status as a Schedule 1 drug, so long as they have less than 0.3% THC.

2020: In Virginia, Senate Bill 918 was passed. It defined hemp extract (including CBD) as an approved food additive, so long as it contains no more than 0.3% THC. It also gave the Virginia Department of Agriculture and Consumer Services (VDACS) the authority to regulate these hemp products. House Bill 962 was also signed, allowing for the sale of hemp CBD smokable products. 

CBD Laws in Virginia: What They Mean

Luckily for Virginia residents, hemp-derived CBD is legal in the state. Under Virginia law, legal hemp products include oil containing an industrial hemp extract, food or food additives meant for human consumption, animal feed, and cosmetics. 

Hemp and CBD is well-regulated in the state. Hemp growers and handlers, as well as processors creating hemp products, are required to register through the VDACS. The VDACS also regulates the labeling and testing of hemp products. 

There are a few things to keep in mind in terms of the future of CBD and hemp in Virginia. To start, House Bill 962 (which allows for the sale of hemp CBD smokable products) goes into effect on July 1, 2020. This means residents 21 and older will be able to purchase and use smokable CBD products, so long as they are properly labeled and tested. 

There will also be some changes to the current hemp plan in the state. Virginia is currently operating its hemp program under the 2014 Farm Bill, which expires in October of 2020. The VDACS submitted a hemp plan to the USDA in early 2020, and it is currently under revision. These new rules likely will go into effect in October, but should not affect access to legal CBD products in the state.
