Luckily for Kentucky residents, the state is among the most CBD-friendly states in the US. Here is everything Kentucky residents need to know about CBD laws and regulations in the state.

Overview of CBD Laws in Kentucky

Let’s take a quick look at the CBD laws that have been enacted in Kentucky and on the federal level over the past few years:

2014: President Obama signed the 2014 Farm Bill, a bill that allowed for the research of industrial hemp (under certain restrictions). In Kentucky, Senate Bill 124 (The Clara Madeline Gilliam Act) passed. It allows CBD to be used to treat certain medical conditions. It also allows the medical schools at the University of Kentucky and the University of Louisville to study CBD oil. Also this year, Kentucky launched its Industrial Hemp Research Pilot Program. The Kentucky Department of Agriculture oversees the program, and all crops grown are for the purpose of research and development. It is illegal to grow and process hemp if not authorized by the KDA.

2017: House Bill 333 was passed in Kentucky. It legalized hemp-derived CBD, excluding it from the definition of marijuana.

2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level.

It removed hemp from the definition of marijuana. This meant that hemp-derived products lost their status as a Schedule 1 drug, so long as they have less than 0.3% THC.

2020: The KDA announced that it would continue operating the hemp program as a research program for another year, and then submit a plan to the USDA and transition into a commercial program.

CBD Laws in Kentucky: What They Mean

So what does this all mean for CBD in Kentucky? In short, Kentucky is a CBD-friendly state. Residents are able to purchase and use hemp-derived CBD products in the state.

As far as hemp production, Kentucky is one of the most well-regulated states. Hemp cultivators, processors, and marketers all have to follow certain guidelines in the state. The KDA gives out licenses to those involved with any of these processes.

Processors and handlers are also required to follow guidelines around manufacturing, testing, and labelling. These regulations likely will continue when the state moves from the Industrial Hemp Research Pilot Program into commercial hemp production.

It should be noted that the marketing and sale of hemp-derived CBD products does not seem to be regulated in the state. More concrete regulations may be put in place when the state moves into commercial hemp production, but as of now, Kentucky consumers need to be particularly cautious when purchasing CBD products in the state.

The KDA has stated that certain CBD products are prohibited for sale, including hemp cigarettes, hemp cigars, chew, dip, and other smokeless material, and hemp leaf material or floral material teas. Whole hemp buds, ground hemp floral material, ground hemp leaf material, and a product containing more than 0.3% THC also cannot be sold to or by anyone who does not hold the proper licensing.

Things to Know When Purchasing CBD in Kentucky

Hemp-derived CBD products aren’t currently regulated in the state, which means consumers need to do their research when purchasing these products in stores. If you are a Kentucky resident who wants to buy CBD products, you need to keep a few factors in mind when you are researching different companies.

One factor to look at is where a company sources the hemp they use to create their products. You’ll want to find a company that sources hemp from US farms that are under strict regulations and have high-quality agricultural practices.

That way, you know a company is using great quality hemp to create great quality CBD products. If a company gets their hemp from an unreputable source – or doesn’t even bother to share where it gets its hemp – you should keep looking.

Another factor you need to look at is the extraction method they use to extract their CBD. Higher-quality companies will use CO2 extraction, a method where a machine uses pressurized carbon dioxide to extract CBD from hemp. This process produces the most potent CBD.

Companies that are trying to cut corners will go with ethanol extraction, a cheaper method. During the ethanol extraction process, the plant is mixed with an alcohol solvent. With this method, it is possible for some of the solvent to be left behind in the CBD. It also leads to less potent CBD.

Finally, you’ll want to make sure a company does third-party testing with their products. This process allows the company to make sure their products contain the right amount of CBD.

Testing is also important because it checks to make sure no harmful elements ended up in the formula. If a company doesn’t do third-party testing, you as a consumer can’t be confident that their products are labelled correctly and completely safe for consumption.
