This bill broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

How to Interpret CBD Laws in Hawaii

While hemp-derived CBD with less than 0.3% THC is legal in all 50 states under the 2018 Farm Bill, officials in Hawaii have stated that these products containing CBD still are not legal within the state. The HDOA has also made it clear that the hemp pilot program only regulates the cultivation of hemp, not manufacturing, processing, sale, or other processes. 

Through a May of 2019 press release, the HDOA stated that the sale of hemp-derived CBD products is unlawful in the state. The press release cites the Food and Drug Administration, which has not approved the use of CBD outside of some medical needs. 

To make matters confusing, there are plenty of CBD shops around Hawaii selling hemp-derived CBD products. Through the press release, the HDOA seemed to communicate that, although they are not actively pulling these products off shelves, the sale is still illegal per the FDA. The press release is more straightforward when it comes to food, beverages, and cosmetics. It clearly states that the addition of CBD to any of these products is prohibited, and that businesses who do so may be at risk of losing their food permit or closure. 

It is important to note that medical marijuana is legal in the state, so it is possible for residents with a medical marijuana card to access CBD products from licensed dispensaries. 

Hopefully, Hawaii officials will more concretely allow for the sale and manufacturing of hemp-derived CBD products. However, as of now, even though residents can find CBD products in the state, CBD remains technically illegal and unregulated.
