CBD Oil Hawaii

Residents in Hawaii may want to know how both the federal and state laws surrounding CBD affect them. Read on to learn everything you need to know about buying CBD Oil in Hawaii.

Are you a resident of Hawaii curious about how CBD laws affect you? This is everything you need to know about using CBD products in the Aloha State.

Overview of CBD Laws in Hawaii

Here is a look at the progression of CBD laws in Hawaii and on the federal level:

2014: President Obama signed the 2014 Farm Bill, which allowed for the research of industrial hemp (under certain restrictions).

2016: In Hawaii, the governor signed Act 228. This act created a hemp pilot program for the cultivation of industrial hemp for agricultural and academic research purposes.

2018: Hawaii’s Department of Agriculture issued the first licenses to growers through the new hemp cultivation program. Through the program, growers need to create reports around planting, harvesting, and movement. Later in the year, the 2018 Farm Bill was signed by President Trump.

This bill broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

How to Interpret CBD Laws in Hawaii

While hemp-derived CBD with less than 0.3% THC is legal in all 50 states under the 2018 Farm Bill, officials in Hawaii have stated that these products containing CBD still are not legal within the state. The HDOA has also made it clear that the hemp pilot program only regulates the cultivation of hemp, not manufacturing, processing, sale, or other processes.

Through a May of 2019 press release, the HDOA stated that the sale of hemp-derived CBD products is unlawful in the state. The press release cites the Food and Drug Administration, which has not approved the use of CBD outside of some medical needs.

To make matters confusing, there are plenty of CBD shops around Hawaii selling hemp-derived CBD products. Through the press release, the HDOA seemed to communicate that, although they are not actively pulling these products off shelves, the sale is still illegal per the FDA. The press release is more straightforward when it comes to food, beverages, and cosmetics. It clearly states that the addition of CBD to any of these products is prohibited, and that businesses who do so may be at risk of losing their food permit or closure.

It is important to note that medical marijuana is legal in the state, so it is possible for residents with a medical marijuana card to access CBD products from licensed dispensaries.

Hopefully, Hawaii officials will more concretely allow for the sale and manufacturing of hemp-derived CBD products. However, as of now, even though residents can find CBD products in the state, CBD remains technically illegal and unregulated.

Can You Buy CBD Oil In Hawaii?

Yes, however while CBD oil is legal in all 50 states, state officials have not permitted the sale of CBD oil in Hawaii. While CBD oil is easily found in retailers throughout the state, technically it is only legally available to those with a medical marijuana card.

What Does This All Mean for Hawaii Residents?

This dichotomy in the state is confusing, but keep this in mind: hemp-derived CBD products are legal on the federal level. Many CBD online retailers are able to legally ship their hemp-derived CBD products around the country. This means that Hawaii residents can access CBD oil and other hemp-derived CBD products. They just need to stay on top of the state regulations and make a decision that works best for them. Hawaii residents looking for regulated, high-quality CBD products will have the best luck purchasing products online from a reputable company.
