2014:

President Obama signed the 2014 Farm Bill which, among other things, allowed for the research of industrial hemp (under certain restrictions). Four months later, Florida passed Senate Bill 1030. This bill allowed certain medical centers to start research on CBD and low-THC cannabis (which in this bill was defined as “a plant of the genus Cannabis, the dried flowers of which contain 0.8 percent or less of tetrahydrocannabinol and more than 10 percent of cannabidiol weight for weight”). 

2018

The 2018 Farm Bill was signed by President Trump. This bill broadened the opportunities for hemp and hemp-derived products on a national level.

The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug. 

2019:

Governor Ron DeSantis signed Florida Senate Bill 1020 on June 25, 2019. This bill helped jumpstart the state’s hemp program and create regulations around hemp and hemp extract in Florida.  

2020:

On January 2, 2020, the Florida Department of Agriculture and Consumer Services started the permitting and inspection process of retail establishments selling CBD products. The department is also testing samples of CBD products being sold.

So what exactly does this all mean for CBD oil in Florida (as well as other CBD products)? Florida is a CBD-friendly state that, as of January 2020, has put regulations around the cultivation of hemp and the sale of hemp-derived products, including CBD oil. 

In Florida, no one can sell or distribute CBD without a specific certificate of analysis that is created by an independent testing laboratory.

This certificate must show that the product was batch tested and proven not to have more than 0.3% THC. The test also must prove that the product doesn’t have any harmful contaminants. Additionally, the packaging must include: 

• The batch number
• The expiration date
• A barcode or quick response code which leads to the certificate
• The web address where batch information is listed
• The milligrams of hemp extract
• A statement that says the product contains less than 0.3% THC
