This is a look at some of the laws and regulations (and attempted laws and regulations) around hemp and CBD over the past few years: 

2014: President Obama signed the 2014 Farm Bill which allowed for the research of industrial hemp (under certain restrictions). 

2015: Bill 1146a was presented in Idaho. It was drafted to give children with epilepsy (and their parents) access to CBD oil with up to 0.3% THC. It was vetoed by the governor.

He then passed an executive order to allow these children and their parents better access to Epidiolex, a medicine containing CBD that is approved by the FDA. 

2018: The 2018 Farm Bill was signed by President Trump, which broadened the opportunities for hemp and hemp-derived products on a national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug. 

2019: House Bill 122 was considered by the Idaho legislature. The bill would have allowed for research, regulations, and production of hemp in the state. It also would have changed the definition of industrial hemp to align with the federal definition. However, this bill did not move forward.  

CBD Laws in Idaho: What They Mean

Idaho has had a difficult time progressing with laws and regulations around CBD and hemp. While it is technically a CBD-friendly state, it has one of the strictest definitions of what legal CBD is. Before diving into this, it is important to know the difference between isolate, broad spectrum, and full spectrum CBD:

  • Isolate: An isolate is the purest form of CBD, containing no additional cannabinoids, terpenes, or flavonoids – essentially no other plant compounds from the hemp plant. This means that it also has 0% THC. 
  • Broad Spectrum: Broad spectrum CBD does contain these plant compounds. However, it is completely free of THC. 
  • Full Spectrum: Full spectrum CBD contains plant compounds, as well as small amounts of THC. Federally legal industrial hemp contains less than 0.3% THC, so these full spectrum products contain only trace amounts. 

While hemp-derived CBD is legal in Idaho, there is one very notable exception: it must contain absolutely no THC, and must come from one of five identified parts of the plant (per the Attorney General’s statement published in 2015). Idaho does not differentiate between industrial hemp with 0.3% or more THC and marijuana.

This means a plant (or product) with any amount of THC is considered a controlled substance in the state, despite the federal law saying otherwise. 

Full spectrum has THC, so it is not legal under these stipulations. While broad spectrum CBD does not contain THC, it can be made from multiple parts of the hemp plant. This excludes it from the definition of legal CBD.

That leaves isolate CBD as the one legal form of CBD in the state, which does put a tight restriction on hemp-derived products.
