2019: House Bill 1349 was passed in North Dakota. It created regulations around the production of hemp, and established a licensing process for cultivators. It also excludes hemp from the definition of marijuana.

Hemp cultivation has been legalized in North Dakota. The definition of legal hemp also encompasses any derivatives or extracts from the plant, so long as they contain no more than 0.3% THC. This means that hemp-derived CBD is legal in the state, under both state laws and the 2018 Farm Bill.
