The CBD Laws Every North Dakota Resident Should Know

Overview of CBD Laws in North Dakota

Here is a look at some of the most recent CBD and hemp laws in the state and in the US:

2014: President Obama signed the 2014 Farm Bill. Among other things, the farm bill allowed for the research of industrial hemp (under certain restrictions). 

2016: In North Dakota, Senate Bill 2344 was passed, creating a medical marijuana program in the state. It allows registered patients to use hemp-derived and marijuana-derived products. The same year, the Industrial Hemp Pilot Program was established in the state. It was created to research the growth, cultivation, and marketing of industrial hemp.  

2018: President Trump signed the 2018 Farm Bill. This bill broadened the opportunities for hemp and hemp-derived products on the national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: House Bill 1349 was passed in North Dakota. It created regulations around the production of hemp, and established a licensing process for cultivators. It also excludes hemp from the definition of marijuana. 

CBD Laws in North Dakota: What They Mean

Hemp cultivation has been legalized in North Dakota. The definition of legal hemp also encompasses any derivatives or extracts from the plant, so long as they contain no more than 0.3% THC. This means that hemp-derived CBD is legal in the state, under both state laws and the 2018 Farm Bill.   

That being said, residents still need to be cautious when buying CBD in the state. The law has not established any regulations around hemp-derived CBD products. This means it is possible for CBD products to be mislabelled, or for formulas to be sold in stores without first being tested. Residents will notice many shops are selling CBD products, but it doesn’t mean they are safe to use. North Dakota did not submit a hemp plan that aligns with the 2018 Farm Bill to the USDA, and the current hemp pilot program (which was created under the 2014 Farm Bill) will expire in October of 2020.
