The CBD Laws Every North Dakota Resident Should Know | EDO CBD

Hemp cultivation is legal in North Dakota, but where does that leave CBD? If you are a resident in the state interested in buying CBD products, read on to learn about the laws you should know.

Overview of CBD Laws in North Dakota

Here is a look at some of the most recent CBD and hemp laws in the state and in the US:

2014: President Obama signed the 2014 Farm Bill. Among other things, the farm bill allowed for the research of industrial hemp (under certain restrictions).

2016: In North Dakota, Senate Bill 2344 was passed, creating a medical marijuana program in the state. It allows registered patients to use hemp-derived and marijuana-derived products. The same year, the Industrial Hemp Pilot Program was established in the state. It was created to research the growth, cultivation, and marketing of industrial hemp.

2018: President Trump signed the 2018 Farm Bill. This bill broadened the opportunities for hemp and hemp-derived products on the national level. The 2018 Farm Bill removed hemp from the definition of marijuana, which meant that hemp-derived products (with less than 0.3% THC) lost their status as a Schedule 1 drug.

2019: House Bill 1349 was passed in North Dakota. It created regulations around the production of hemp, and established a licensing process for cultivators. It also excludes hemp from the definition of marijuana.

CBD Laws in North Dakota: What They Mean

Hemp cultivation has been legalized in North Dakota. The definition of legal hemp also encompasses any derivatives or extracts from the plant, so long as they contain no more than 0.3% THC. This means that hemp-derived CBD is legal in the state, under both state laws and the 2018 Farm Bill.

That being said, residents still need to be cautious when buying CBD in the state. The law has not established any regulations around hemp-derived CBD products. This means it is possible for CBD products to be mislabelled, or for formulas to be sold in stores without first being tested. Residents will notice many shops are selling CBD products, but it doesn’t mean they are safe to use. There are a few factors consumers in North Dakota need to be aware of when buying CBD products – we will cover some tips below.

North Dakota did not submit a hemp plan that aligns with the 2018 Farm Bill to the USDA, and the current hemp pilot program (which was created under the 2014 Farm Bill) will expire in October of 2020. This means the future of hemp and CBD production is uncertain in the state, but for now, CBD is legal but unregulated.

Is CBD Oil Legal in North Dakota?

The CBD oil laws in North Dakota allow for the use of the product in the state, so long as it contains less than 0.3% THC. Like other CBD products, however, CBD oil remains unregulated.

Things to Know When Purchasing CBD in North Dakota

As established above, while CBD is legal in North Dakota, CBD products are not currently regulated. Residents that want safe, high-quality products need to do their research to find reputable CBD companies. What makes a trustworthy CBD company? There are three main factors you should look at:

Where does the company get its hemp?

A trustworthy company knows that in order to make top of the line CBD products, you need to use high-quality hemp. CBD brands should know exactly where their hemp comes from, and the conditions in which it was grown. Companies that buy CBD from unreliable sources are only going to make substandard CBD products.

How does the company extract CBD?

The method of extraction used to extract CBD from the plant also plays a big part in the quality of a CBD product. A higher-quality method is CO2 extraction, where a machine uses pressurized carbon dioxide to extract the CBD. A lower-quality method is ethanol extraction, where the plant is mixed with an alcohol solvent. This not only leads to less potent CBD than what you get with CO2 extraction, but it also creates the risk of traces of alcohol being left behind in the CBD.

Does the company do third-party testing?

This is perhaps the most important factor to look for. If a company neglects to do third-party testing with all of its products, there is no way to guarantee the formulas contain the amount of CBD listed on the label. You also can’t be sure that there aren’t any harmful elements in the formula. For your safety, it is best to avoid any companies that don’t do third-party testing.

Since CBD isn’t regulated in North Dakota, the safest option for residents is to buy CBD online from a reputable company that meets these standards.
