On the federal level, President Obama signed the 2014 Farm Bill, a bill that allowed for the research of industrial hemp, under certain restrictions. 

2015: The ODA finally drafted rules for hemp production as enabled through Senate Bill 676, and these rules went into effect in February of 2015. The state’s hemp program requires certain sampling, testing, and investigative processes, as well as licensing through the ODA. The ODA started accepting licenses for hemp cultivation this year. 

2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. It removed hemp from the definition of marijuana. This meant that hemp-derived products lost their status as a Schedule 1 drug, so long as they have less than 0.3% THC.

2019: The ODA adopted permanent rules regarding hemp and hemp-derived products. Among other requirements, these rules establish testing requirements for hemp-derived products.

Since marijuana is recreationally legal in the state, residents can also obtain marijuana-derived products with higher amounts of THC. These products are overseen by the OLCC, while hemp is overseen by the ODA.

Hemp and hemp-derived products are well-regulated in the state. The ODA issues licenses to growers and handlers of hemp. Retailers selling CBD products and CBD Oil Oregon are not required to obtain a license, so long as the products contain less than 0.3% THC and are not advertised as a dietary supplement.

There are certain labelling requirements that have been established for hemp-derived products. They must contain a hemp symbol that has been created by officials to differentiate between hemp and marijuana products. A label must also include warning statements about the possibility of THC in the product, and that the product hasn’t been approved by the FDA. Additionally, the label needs to disclose the concentration of CBD and THC, the business/licensee name and number, and a unique identifier number. Testing needs to check for the CBD and THC concentration, as well as any other contaminations. 

There is one restriction around CBD that consumers in Oregon should be aware of. At the end of 2019, the OLCC issued guidelines that stated that Oregon CBD was prohibited from being included in alcoholic beverages.
