Many know that Oregon is marijuana-friendly, but how about Oregon CBD? We’ll cover all of the CBD laws and regulations that residents in Beaver State should know. We answer the question “Where to buy CBD oil in Oregon?”.

Overview of CBD Laws in Oregon

These are some of the most pertinent laws relating to the cannabis plant and CBD:

2009: Senate Bill 676 was passed in Oregon. It legalized the cultivation and possession of hemp in the state, and differentiated hemp from marijuana. It also gave the Oregon Department of Agriculture (ODA) the authority to create regulations and a licensing process around cultivation.

2014: In Oregon, Measure 91 was approved, also known as the Control, Regulation, and Taxation of Marijuana and Industrial Hemp Act. This legalized marijuana for recreational use in the state, and gave the Oregon Liquor Control Commission (OLCC) the responsibility of regulating marijuana sales. On the federal level, President Obama signed the 2014 Farm Bill, a bill that allowed for the research of industrial hemp, under certain restrictions.

2015: The ODA finally drafted rules for hemp production as enabled through Senate Bill 676, and these rules went into effect in February of 2015. The state’s hemp program requires certain sampling, testing, and investigative processes, as well as licensing through the ODA. The ODA started accepting licenses for hemp cultivation this year.

2018: The 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. It removed hemp from the definition of marijuana. This meant that hemp-derived products lost their status as a Schedule 1 drug, so long as they have less than 0.3% THC.

2019: The ODA adopted permanent rules regarding hemp and hemp-derived products. Among other requirements, these rules establish testing requirements for hemp-derived products.

CBD Laws in Oregon: What They Mean

CBD Laws Oregon

Oregon has had a multi-year evolution in regards to hemp, but what does this all

mean for CBD in Oregon? Thankfully for residents, Oregon is CBD-friendly. Consumers can purchase hemp-derived products that contain no more than 0.3% THC. Since marijuana is recreationally legal in the state, residents can also obtain marijuana-derived products with higher amounts of THC. These products are overseen by the OLCC, while hemp is overseen by the ODA.

Hemp and hemp-derived products are well-regulated in the state. The ODA issues licenses to growers and handlers of hemp. Retailers selling CBD products and CBD Oil Oregon are not required to obtain a license, so long as the products contain less than 0.3% THC and are not advertised as a dietary supplement.

There are certain labelling requirements that have been established for hemp-derived products. They must contain a hemp symbol that has been created by officials to differentiate between hemp and marijuana products. A label must also include warning statements about the possibility of THC in the product, and that the product hasn’t been approved by the FDA. Additionally, the label needs to disclose the concentration of CBD and THC, the business/licensee name and number, and a unique identifier number. As far as testing, every product must be tested by the handler before the sale or transfer to a consumer. Testing needs to check for the CBD and THC concentration, as well as any other contaminations.

There is one restriction around CBD that consumers in Oregon should be aware of. At the end of 2019, the OLCC issued guidelines that stated that Oregon CBD was prohibited from being included in alcoholic beverages.

Things to Know When Purchasing Oregon CBD

CBD is well-regulated in Oregon, but that doesn’t mean every CBD product on the shelf is created equally. The quality of Oregon CBD products available for sale will vary from company to company, so it is important to look into a few key factors to determine whether a business is producing the best of the best.

It is important to look at what hemp a company uses, because the quality of hemp greatly impacts the quality of the CBD product.

The best companies will source their hemp from well-regulated farms with strict agricultural practices in place. If a farm has weak agricultural practices, they’ll be producing substandard hemp.

It is also a good idea to look at what extraction method a company uses. The method that yields the best results is CO2 extraction, where a machine uses pressurized carbon dioxide to extract CBD from the hemp. A lower quality method is ethanol extraction, where the plant is mixed with an alcohol solvent. Not only does this lead to less potent CBD than you get with CO2 extraction, but there is also a risk that some alcohol can be left behind in the extracted CBD.

Finally, it is important to make sure a company does third-party testing. While Oregon does have testing requirements in place, it is best to ensure all products a company produces are properly tested. Through third-party testing, companies can ensure that their products contain the right amount of CBD, and that there aren’t any harmful elements in the formula.
