2014: President Obama signed the 2014 Farm Bill, a bill that allowed for the research of industrial hemp, under certain restrictions. 

2016: In Rhode Island, House Bill 8232 (also known as the Hemp Growth Act) was signed into law. It differentiated hemp from marijuana, and permitted licensed individuals to cultivate and distribute hemp for commercial purposes. It also gave the Department of Business Regulation the authority to establish rules and regulations to regulate hemp growers and processors. 

2018: In October, the Industrial Hemp Agricultural Pilot Program was established in Rhode Island. It established licensing and regulation requirements for hemp and hemp products in the state, as determined by the Department of Business Regulation. This includes certain testing, labelling, and extraction rules. A couple months later, the 2018 Farm Bill was signed by President Trump. This bill broadened the agricultural and commercial opportunities for hemp and hemp-derived products on a national level. It removed hemp from the definition of marijuana. This meant that hemp-derived products lost their status as a Schedule 1 drug, so long as they have less than 0.3% THC.

2019: In Rhode Island, the Hemp Growth Act was revised. This update created rules and regulations around CBD, which hadn’t been explicitly mentioned in prior laws. 

CBD Laws in Rhode Island: What They Mean

What exactly do these laws mean for residents of Rhode Island who want to buy and use CBD products? Luckily, CBD is perfectly legal in the Plantation State. It is legal to sell hemp-derived CBD products, so long as they contain no more than 0.3% THC. 

Under state law, all growers, handlers, retailers, and distributors of hemp and hemp products (including CBD) must obtain a license through the Department of Business Regulation. Hemp and hemp products must go through certain testing requirements to ensure they do not exceed the legal amount of THC. There are also labelling requirements. CBD products must have a label that includes tracking information for the hemp source, extraction method information and solvents used, the amount of CBD and THC, and a warning that the product hasn’t been approved by the FDA. They also can’t contain any medical claims. 

While some states have shied away from allowing the combination of CBD and food, the 2019 laws allow for the sale of CBD-infused foods and beverages in Rhode Island. As far as consumable CBD products, consumers must be 21 and older to purchase these products. Beyond food and beverages, this restriction also includes products like CBD oils.

It involves mixing the plant with an alcohol solvent, which means there is a risk that alcohol can be left behind in the extracted CBD. It also leads to less potent CBD than what you get with CO2 extraction.

Third-party testing ensures that a product contains the right amount of CBD, as well as no harmful elements.
