It removed hemp from the definition of marijuana. This meant that hemp-derived products lost their status as a Schedule 1 drug, so long as they have less than 0.3% THC.

2020: In Virginia, Senate Bill 918 was passed. It defined hemp extract (including CBD) as an approved food additive, so long as it contains no more than 0.3% THC. It also gave the Virginia Department of Agriculture and Consumer Services (VDACS) the authority to regulate these hemp products. House Bill 962 was also signed, allowing for the sale of hemp CBD smokable products. 

CBD Laws in Virginia: What They Mean

Luckily for Virginia residents, hemp-derived CBD is legal in the state. Under Virginia law, legal hemp products include oil containing an industrial hemp extract, food or food additives meant for human consumption, animal feed, and cosmetics.

The VDACS submitted a hemp plan to the USDA in early 2020, and it is currently under revision. These new rules likely will go into effect in October, but should not affect access to legal CBD products in the state.
